Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Estacc website and the Estacc SME application (together, "Estacc"), provided by Estinopo Technologies Inc. ("Estinopo," "we," "us," or "our"). By accessing or using Estacc, you agree to be bound by these Terms. If you do not agree, please do not use Estacc.

About Estacc

Estacc is a family of accounting technology products for Philippine businesses and accounting professionals. Estacc SME is currently available. Estacc Practice and Estacc Enterprise are described on this website as planned products and are not yet available. Features may change, and any forward-looking descriptions are not a commitment to deliver specific functionality by any particular date.

Eligibility and accounts

You must be at least 18 years old and capable of forming a binding contract to use Estacc. If you use Estacc on behalf of a business, you represent that you are authorized to bind that business to these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please provide accurate information and keep it up to date, and notify us promptly of any unauthorized use.

Your data and its accuracy

You are responsible for the information you enter into Estacc. The summaries, computations, and reports Estacc produces depend on the data you provide; inaccurate or incomplete entries will affect the results. You should review outputs for your specific circumstances before relying on them.

Tax assistance — important

Estacc SME assists you with bookkeeping, tax computation, and filing preparation. It helps you record transactions, understand your numbers, estimate applicable taxes, and see the amounts to enter into applicable BIR forms.

Estacc SME does not file or submit tax returns to the Bureau of Internal Revenue (BIR) on your behalf. You remain solely responsible for reviewing your figures and for submitting your own returns through the appropriate BIR channels, such as eBIRForms or eFPS.

Estacc is a software tool and is not a substitute for professional tax, accounting, or legal advice. Estacc does not claim BIR accreditation, certification, authorization, or endorsement. Tax computations are estimates based on the information you provide and applicable rules as implemented in the software, and should be verified for your situation.

Acceptable use

You agree not to misuse Estacc. In particular, you will not use Estacc for any unlawful purpose; interfere with or disrupt its operation or security; attempt to gain unauthorized access to any system or data; reverse engineer or copy the software except as permitted by law; or use it to infringe the rights of others.

Intellectual property

Estacc, including its software, design, and the Estacc and Estinopo names and logos, is owned by Estinopo Technologies Inc. and protected by applicable laws. These Terms do not grant you any ownership of Estacc. You retain ownership of the data you enter, and you grant us a limited license to process that data solely to provide and improve the service for you.

Third-party services

Estacc may work alongside third-party services you choose to use, such as the BIR's eBIRForms or eFPS systems and your bank. Those services are provided by third parties under their own terms, and we are not responsible for their availability, accuracy, or actions.

Fees

Where a paid plan applies, the applicable fees and terms will be communicated to you separately. Pricing for Estacc Practice and Estacc Enterprise has not been published and will be provided when those products become available.

Disclaimers

Estacc is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Estacc will be uninterrupted, error-free, or that computations will meet every regulatory interpretation applicable to your circumstances.

Limitation of liability

To the fullest extent permitted by law, Estinopo Technologies Inc. will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of Estacc. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

Indemnification

You agree to indemnify and hold harmless Estinopo Technologies Inc. from claims, damages, and expenses arising out of your misuse of Estacc or your breach of these Terms or applicable law.

Suspension and termination

We may suspend or terminate access to Estacc if you breach these Terms or to protect the service and its users. You may stop using Estacc at any time. Provisions that by their nature should survive termination will survive.

Changes to the service and these Terms

We may modify Estacc and these Terms from time to time. When we change these Terms, we will update the "Last updated" date above. Your continued use of Estacc after changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-laws principles, and you agree to the exclusive jurisdiction of the competent courts of the Philippines for any dispute arising from these Terms or your use of Estacc.
